If you have had your check writing privileges suspended, had a bank account closed, or been denied a new bank account because of ChexSystems reports that are not your fault and are out of your control, the first thing to do is to call CFS and ask for help.
While the issue is being rectified, you may be able to make some headway with your bank by presenting your case.
Get a Copy of Your ChexSystems Report
Obtaining a copy of your report is the first step towards both disputing it and clearing your name. Make a copy of your report, and keep the original. Mark the copy up to clearly highlight the incorrect information, and explain why it is incorrect.
Collect All of the Information
If you have supporting documentation that explains why the ChexSystems report is wrong, gather it together. It helps to bolster your case if you can show that your social security number is indeed not the one listed, or that the report has confused you with someone else who has a similar name.
Have Important Documentation Notarized
You can often have this done at your very own bank. Signing an affidavit that you are presenting true and correct information goes a long way for banking officials who can see you are serious. The fee is well worth it. Double check your items before signing, as this is a legal document and could be used in court.
Don’t be Belligerent
Instead of demanding the bank “fix” the error, be supplicant instead. In many cases you are dealing with someone who had no control over the incorrect report, and they won’t appreciate anger or hostility. What they will appreciate is being asked nicely to help you, and given tools that can justify making a decision in your favor.
Be Willing to Bend over Backwards
Offer to take a class in financial management or go to checking-account school. If your case has nothing to do with fraud, you can prove you are willing to learn and follow instructions to be a more responsible checking account holder. This is especially helpful if you have ever made an honest mistake – such as overdrafting your account or incurring an NSF fee – which could now compound the problem you find yourself facing.
Have a Backup Plan
If worst comes to worst, be thinking ahead to opening an account with a bank that doesn’t use ChexSystems. You can get a head start on rebuilding your good name while things get worked out with your original bank, and regain check-writing privileges.
These tips can help you talk to your banking official and possibly avoid having a ChexSystems report ruin your banking history.
